I. Video Classes License Agreement:
- Vsmart Video Content is sold for registered single users only. No sharing of video content in a group or sub sharing is allowed as per this agreement.
- No external Transfer of video content to any other device is allowed in this agreement such as television or projector and shall be restricted to laptop or android phone or tablet only.
- No external recording of video content by screen recording application or using external camera or by any means is allowed in this agreement.
- Breach of this agreement leads to complete block of video classes and lawful action under the copyright act of 1957 and penalty upto 20 lakhs.
Copyright
- The Content is copyrighted and protected under the Indian Copyright Act of 1957, The Content shall remain the sole and exclusive property of VSMART ACADEMY. Use of the Content is licensed, not sold, pursuant to the terms of this License Agreement. Use of the Content without agreeing to this License Agreement, or a breach of these License Agreement terms, is copyright infringement.
- VSMART ACADEMY grants you a non-exclusive and non-transferable license to use the Content only as provided in this License Agreement. Unauthorized copying, re-recording, broadcasting, public performance, hiring or rental of this recording in whatever manner is strictly prohibited under the Indian Piracy Law & Copyright Act of 1957.
Definition :
- “Content” shall mean animations, templates clipart, footage, graphics, music, sounds, and text regardless of whether the Content is obtained delivered via any Storage Media, or obtained from a VSMART ACADEMY authorized distributor, together with all accompanying material.
- “Storage Media” shall mean PEN DRIVE, digital video disc (DVD), or any other storage device or media now known, or hereafter created.
- “User” shall mean the individual, legal entity or agent entering into this license agreement or any employee or contractor of such individual, legal entity or agent that accesses the Content. All Users shall only use the Content in accordance with the terms of this Agreement
2. Replacement Policies
The product can only be replaced with the same product within (5) five days with the same course/product/item only with the following condition.
- If received a wrong course/product/item
- If received product is damaged or non-working condition.
- If the received product or Vsmart software/player is not functional under valid Laptop configuration and cannot be resolved remotely by the technical team.
Note :
Replacement can be claimed for tangible products like printed material / USB / DVD / CD / Pen drive etc.
How to do this?
Step 1: Email your product replacement request to contact@vsmartacademy.com asap with Subject Line: “Product replacement with course name” and with your purchased order details and genuine reason for product replacement.
Replacement claim shall be emailed immediately or with five (5) days from the date of product received. We request you to please attach videos/photos if the product is damaged or wrong receivable of content.
Step 2: An email ticket will be generated for your request & Vsmart team will review your request and may ask you all necessary details as needed.
You must provide all required details within three (3) days from the date of email request from Vsmart team.
Step 3: This request will be forwarded to Vsmart management approval.
Step 4: Once your request is approved, you have to send the wrong / damage / non-working product back to Vsmart Academy return address - provided to you in your email.
You have to return/send the product within three (3) days.
Step 5: After sending the product, you have to email your return confirmation or tracking details to the Vsmart team under the same email or ticket.
Step 6: Once Vsmart receives original product back at given address, Vsmart team will immediately process & dispatch new product back to your registered address.
Step 7: Vsmart account team may take 2 to 3 days for initiating the refund. You will receive the refund initiated confirmation email for your reference.
Note 1: Vsmart Academy reserves all the rights to accept or reject a replacement claim made by you under genuineness and to replace a product with a new / fresh product.
Note 2: All the Vsmart products are non-cancellable products and no order can be cancelled. It can only be replaced or exchanged as per Vsmart “Exchange Policy”.
3. Cancellation Policy:
All the Vsmart products are non-cancellable products and no order can be cancelled. It can only be exchanged as per Vsmart “Exchange Policy”.
4.Exchange Policy:
No product exchange is allowed with other Vsmart products for any common reasons, or change of mind, or product is used.
Exchange of product is only allowed for genuine reason only, subject to management approval on case to case basis. (if the product is in “as is” new condition and has not been used.)
Exchange of product is only allowed with other Vsmart products If the request received within 24 to 48 hrs from the date of purchase order (PO)
- a) and order is not dispatched or not picked up then: Total amount 100% will be refunded.
For example – (Purchase Value, Rs. 10,000) – (Exchange processing Charges, Rs. 0) = (Refunded Value, Rs. 10,000)
- b) and if order is dispatched or picked up then: Total amount less shipping charges will be refunded if order is dispatched.
Refunds will be initiated after receiving a return shipment from the customer.
For example – (Purchase Value, Rs. 10,000) – (Shipping Charges, Rs. 500) = (Refunded Value, Rs. 9,500)
*In this case, you have to return the product as your cost.
How to do this?
Step 1: Email your product exchange request to contact@vsmartacademy.com asap with Subject Line: “Exchange of Product with course name” and with your purchased order details and genuine reason of exchange.
Step 2: An email ticket will be generated for your request & Vsmart team will review your request and may contact you to understand the reason one to one basis.
Step 3: This request will be forwarded to Vsmart management approval.
Step 4: Once your request is approved, Vsmart team will ask you to place a new order for another Vsmart product you wished to purchase.
Step 5: Once you purchased a new product, you are required to email your new purchase order to the same email or ticket, you were communicating with Vsmart.
Step 6: Once you send your new purchase order, Vsmart team will forward your email to Vsmart account team for initiating the refund of your first/previous order.
Step 7: Vsmart account team may take 2 to 3 days for initiating the refund. You will receive the refund initiated confirmation email for your reference.
Note: The time taken for the refund to be reflected in your bank account is completely dependent on the banking process and Vsmart can not do much in this process except coordinating with the Vsmart bank for you.
5. Course Activation Time Limit:
- 1. You have to activate the product (video classes) within 6 months (180 days) from the date of purchase order (PO) for any technical support on course activation.
- 2. Course validity (for example 6 months) will only start from the date of course activation.
- 3. Case 1: If you have purchased a video course on 1st Jan and activated your course on the same day using activation code/key then your course will be having 6 months (180 days)
- validity to watch these video classes. That means, this course will expire on 30th June
- 4. Case 2: If you have purchased a video course on 1st Jan but for some reason you have activated your course after 3 months (1st April) using activation code/key then your course will still be having validity of 6 months from the date of activation. That means, this course will expire on 1st September.
- 5. Case 3: If you have purchased a video course on 1st Jan then you are having a maximum 6 months (180 days) to activate this course. That means you have to activate your course on or before (30th June) using activation code/key. If you activate the course on 30thjune then your course validity will start from the same date till next 6 months, that means, this course will expire on 30th Dec.
- 6. Video Course is provided with a playback time limit. (For Example 1.5 time video play time for each video lecture. Therefore, for 3 hrs video lecture, you will be provided with 4.5 hrs total play time. In this total play time, you can start or stop the videos as many times as you want. No pause time is counted in this case. However, once the total time is consumed, video will stop permanently for further play and cannot be re-activated or provided with any extra time.
Note: Video play time will be counted with your video play speed. For example, if video play speed is 1.0x then video play time counted accordingly, if you increase the speed of video to 1.5x then video playtime counting will match the 1.5x speed.
6. Course Re-Activation:
Existing customer can request for course reactivation with following terms & conditions.
- Our video classes are provided with one time free activation of video classes.
- However, in many reason customer request for reactivation of course from one winow laptop to another, or formatting of same laptop due some reason or using activation code on wrong desktop or mac laptop/pc and many more case. In this case, we do help our customers in reactivating their course on same or different window laptop. However, this process requires re-generation of code from server and cost us money. Therefore, every reactivation of course has to pay Rs. 500 by the customer for their any own reason.
- Course reactivation doesn’t mean renewal of no. of views or renewal of video play time of classes. No extra views or play time is provided for your video classes in reactivation.
- There is no option to renew no. of views or play time of video classes. In this case, you have to purchase new course at our website (www.vsmartacademy.com)

7. Course Validity Extension + Video Lecture Views Renewal/Reset
If you have purchased any course in last attempt and haven’t been able to watch or finish your course within course validity time and want to extend course validity
Or you have watched a few video lectures of this course and now want to watch all the video lectures from the start for the next attempt, in that case you can re-set/renew views of the entire course under the following condition.

Note 1:- Course Validity Extension:
a. Our video classes are having certain validity from the date of course activation. In other words, course/video classes will be expired after 6 months from the date of course activation and no further watching of course is possible.
b. Extension of course is only possible after current expiration of course validity.
c. This offer is allowed only one time within 18 months from the date of course purchased (PO).
d. Discount & Pricing will be calculated based on your order value or invoice value.
e. In this case, you will not be provided with any new course content. This is just a validity extension of your existing course
Note 2 Course validity extension+Course View Renewal/Reset:
a. Total time watched is of entire course and not per lecture
b. This offer is allowed only one time within 18 months from the date of course purchased (PO)
c. Discount & Pricing will be calculated based on your order value or invoice value.
d. In this case, you will not be provided with any new course content. This is just an re-set & extension of your existing course

8. Replacement of Old Course Content (Lectures + Books) with New Course Content
If you have purchased any course in last attempt and if you didn’t get a chance to watch & complete your course in that attempt for any reason, and want to fresh start your new attempt preparation with new lectures & course material, in that case you can replace the old course content with new one under following conditions with certain discount offering.
